Conditions of Sale Cappelletto Shop
By placing an order you are making an offer to purchase a product on the following terms and conditions. All orders are subject to availability and confirmation of the order price.
Your order is subject to the availability of the product in stock. CappellettoShop does not guarantee the availability of the product in your cart. If the product you selected and ordered is not available, you will be immediately notified by our store for an alternative product or to notify you of the cancellation of the order itself.
Shipping times may vary based on product availability and any guarantees or forecasts regarding delivery times are limited to Italy and subject to any delays due to the courier service we rely on or to force majeure for which we will not be responsible. Please see the Shipping page for more details on delivery costs.
To conclude a contract with CAPPELLETTO SHOP (Cappelletto srl Company) you must be 18 years of age or older and have a valid credit or debit card issued by a bank deemed reliable by us. CAPPELLETTO SHOP reserves the right to refuse an order placed by minors.
When placing an order you undertake that all details you provide to us are true and accurate, that you are an authorised user of the credit or debit card used to place the order and that there are sufficient funds to cover the cost of the products. The cost of foreign products and services may be subject to change. All prices quoted are subject to such changes.
Our Contract
When you place an order, you will receive an email confirming receipt of your order: PURCHASED ORDERS CAN NO LONGER BE CANCELLED. EVEN IN THE CASE OF ORDERING PRODUCTS WITH DELIVERY TIME LIMITS OR PRODUCTS ORDERED EXPRESSLY FOR THE CUSTOMER.
a. Price and Availability
Whilst we try to ensure that all details, descriptions and prices appearing on this website are accurate, errors may occur. If we discover an error in the price of any goods you have ordered, we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you, we will treat the order as cancelled. If you cancel your order after you have already paid for the goods, you will receive a full refund. Where applicable, the price includes VAT. Delivery costs will be added separately; such additional costs are clearly shown where they apply and are included in the "total cost".
b. Payment
After receiving your order we carry out a standard pre-authorisation check on your payment card to ensure there are sufficient funds to complete the transaction. Goods will not be dispatched until this pre-authorisation check has been completed. We will debit your card after your order has been accepted.
The confidential data of the payment card (card number, expiration date, CVV code), are encrypted and transmitted directly to the payment manager. The seller therefore never has access to and does not store the data of your credit card.
c. Payment with ScalaPay
If you buy with Scalapay you receive your order immediately and pay in 3 installments. You acknowledge that the installments will be assigned to Incremento SPV Srl, related parties and their assignees, and that you authorize such assignment.
d. Customs duties for purchases from non-EEC countries
By placing an order on CappellettoShop the user accepts the possibility that the products are subject to customs duties, postal, transport and import taxes in the country of residence of the user and that these taxes are independent of the control of Cappelletto. Cancellations of orders are not accepted once they have left our stores.
In particular, we advise that customs duties for imports to the United Kingdom on shoes can reach up to 40% of the cost of the shoes themselves. By ordering on CappellettoShop, the customer accepts the payment that will be requested by DHL for the customs duties required for the delivery of the order to its destination. If the customer refuses to receive his order that has already arrived at customs, CappellettoShop will arrange for the package to be returned to Italy and will deduct from the refund both the return shipping costs and the customs duties for the return of the goods.
Please note that shipping costs for the UK are €30.
We also inform you that the change in the area of Venice Island and neighboring islands will not be free.
e. Right of Withdrawal
You have the right to withdraw from the contract without any penalty within 14 days of receiving your order. The right of withdrawal is exercised by written communication sent by email to the address: info@cappellettoshop.it .
CAPPELLETTO SHOP will refund the expense incurred by you within and no later than ten working days from receipt of the return. Shipping costs in the event of a return are always at your expense. Go here for more information
f. Discount Codes
Account Discount Codes - Discount codes may be offered to account holders from time to time; such codes may only be applied to purchases made through the account for which a discount code was offered and registered. It is not transferable.
g. Promotional discount codes - From time to time we may offer promotional discount codes which may apply in relation to all or specific purchases made through this website.
These terms and conditions apply to all promotions run by CAPPELLETTO SHOP , competitions and discount codes (unless otherwise stated).
• Discount codes cannot be combined. Only one can be used per order
• Some brands may be excluded from some promotions. Brand exclusions will be advertised as Continuous.
h. Gift voucher
We will ship your gift card as soon as payment is confirmed or on the delivery date you specify (whichever is later). Unfortunately, we cannot be held responsible for any delays, regardless of the reason. Gift cards must be spent within 12 months of issue.
i. Defective Product
Each product is checked before being shipped and CappellettoShop documents the condition of the product with photos. However, if the product should present any defect upon arrival, the customer must immediately send an email to info@cappellettoshop.it, indicating the alleged defect and attaching any supporting documents (detailed photos of the product, order number, etc.). In the event of a recognized defect, CappellettoShop undertakes to detect the product to inspect it. Only in the event of a recognized defect, Cappelletto undertakes to replace the defective product or, if this is not possible, to partially or totally refund the purchase price depending on the nature of the defect.
CappellettoShop reserves the right to refuse to follow up on a late complaint (after the fifth day from the date of receipt of the order by the customer), a complaint relating to normal wear and tear, a defect for which the user is responsible or which derives from the nature of the product. Some products may have irregular parts and/or irregularities that are part of the manufacturing process or correspond to the material used.
l. Resale
The products for sale on CappellettoShop are available for personal sale and not for resale. By placing an order on the site, the User guarantees that he/she will use the product only for personal use. Furthermore, orders with more than four quantities of the same product will not be accepted.
m. Retreat
You can pay for our collection service using the credit/debit card you would normally use to pay for our products and our terms of sale also apply to this service. Please note that we do not accept gift vouchers or discount codes as part or full payment for this service.
An address that the courier can access is required and a responsible adult must be present to deliver the goods. If the courier is unable to collect your goods, you will still be charged for the service.
In the event that your goods are not collected due to an error by the courier or CAPPELLETTO SHOP , we will refund the cost of the service.
Goods subject to return are all subject to our returns policy and collection of the same does not imply acceptance of their return.
n. Refusal of an order
The Seller reserves the right to refuse or cancel orders that come from:
- from a user with whom the Seller has an ongoing legal dispute
- by a user who has previously violated the General Conditions of Sale
- from a user who has provided incomplete or otherwise inaccurate data, or false identification data.
- by a user who has cancelled an order for a continuous product ordered expressly for him/her.
- from a user who has purchased more than one size of a product whose description specified the possibility of purchasing one size per order.
